Representation of Partition of India in Sunlight on a Broken Column, Ice-Candy Man, and 1947 Earth

Partition of India, which is almost overlooked in traditional historiography with India’s Independence and Birth of Pakistan, led to one of the largest and bloodiest migrations in the history of the world. Sunlight on a Broken Column, Ice-Candy Man and 1947 Earth are all set in the same time span and portray Partition in quite different ways. Different as in not only different from each other, but also different, more significantly, from the way it is portrayed in traditional historiography. Traditional historiography merely gives facts and figures without examining all its social, political, economical, cultural and psychological effects. Also, it is largely governed by national biases and hence, tends to sweeps under the carpet anything that projects a negative image of the nation or raises a finger at its pet ideologies. Hence, it not only fails to give a true picture but is also, incapable of examining â€Å"why? † or linking the past with the present as in bringing out the relevance of it as of now. The above three texts, to a lesser or greater extent do precisely that, as in question the traditional historiography. And, I think that’s where their merits lie. Sunlight on a Broken Column which focuses chiefly on how it was an era of changes and change whether it be for good or for bad cannot occur without pain examines the causes of partition most effectively. Not only was it the end of colonial rule, resulting into a power struggle between Hindus and Muslims (with Muslims having ruled over India for centuries before British and the Hindu dominated Congress gaining power after them) but, it also marked the end of feudalism which is very significant as in it brings to light the power struggle that occurred amongst Hindus and Muslims themselves. A society based on class (feudal lords) was being replaced to that governed by caste (Congress, Muslim league). That is, change or reversal of Power roles occurred not just at a political level between Hindus and Muslims or British and Indians (as in colonial India) but, also at a social level amongst the Hindus as well as amongst the Muslims themselves. To quote from the text: â€Å"For times had changed sadly since the integration of the Princely States, and Their Highnesses were left with itles, no states, reduced incomes and unchanged habits and tastes, To play polo, entertain, race, drink, flirt or fornicate with the proper air of aristocratic nonchalance needed co-operation between those who had the means and those who had the titles. † Also, psychologically, it brings out the conflict between modernity and tradition as in the Laila, â€Å"I felt I lived in two worlds; an observer in an outside world, and solitary in my own†¦. Because on one hand was the very strong urge to cling to all that was Indian as in not imported or forced on by the British while, on the other hand was the need and desire to break free from the old, rotten customs. Or in other words, an individual’s cultural identity was being questioned. Which, on summing up gives a very different cause of the riots and the massacre, as in it was â€Å"A resistance to change that changed everything†. That is, contrary to what we would like to believe, British might be one of the several reasons but, they are certainly not the only ones to blame. The causes were manifold and lay very much within India. Divide and rule policy of British was not the only reason. This fact is also brought out through Saleem’s character in the text. Saleem believed and blamed the divide and rule policy of British initially but, later his opinions changed he blamed the Congress leaders (very much Indian! ) instead and himself become a supporter of the Muslim League. Partition did not occur all of a sudden but, it was a gradual process that occurred at all levels, most importantly, inside the minds of people! Talking about the implications, it happens to be the only text among the all three which talks of breaking up of families (or partition within them) due to the geographical partition of India. It also brings out the economical implication as in loss of property due to evacuee property being allotted to refugees by having to not only move out of the old zenana but, also sell it and the bitterness caused in Aunt Siara because of it. Besides, by writing about the partition chiefly in the last section as a retrospect which has a very strong sense of nostalgia running through it she emphasizes the fact that the past won’t ever return but, won’t ever be forgotten as it’s effects are everlasting and especially for those who suffered in partition (loss of near and dear ones etc) tomorrows will always be yesterdays. But, on the negative side it is very much a Pro India, Pro Gandhi novel, a very very strongly biased text. For eg, it kind of patronizes the Muslims who stayed in India while, calling those who left â€Å"traitors†. Also, the novel manipulates the readers’ sympathies towards the characters very effectively which in turn are linked to the ideologies they stand for. For eg, in the arguments between Kemal and Saleem one tends to clearly sympathize with Kemal, same with Laila vs Zahra and also, Laila vs Nadeera (towards the end). And, most importantly, Asad who is portrayed as someone to be looked up to and respected stands for the Gandhian ideology. The novel ends with a kind of moral preaching by Asad, and Laila, a confused person who follows no particular ideology accepting him and embracing his ideology. Towards ‘the end’, there is the sense that the Gandhian Ideology wins. Perhaps coz she’s trying to imply that now it’s the only possible solution to the problem left. But, most importantly of all, the abduction of women is very marginally mentioned and ‘women’s recovery camp’ is only indirectly hinted to in an otherwise feminist text. Though, she does question patriarchal power system by the character of Sita. Unlike the Ramayana’s Sita, this Sita stays by her own personal choice with Ravana and questions Ram’s ideology by saying, â€Å"I think it is the sense of possession in a man that is hurt, not his sense of morality†. But, it’s quite indirect not an obvious link. On the whole, through Sunlight on a Broken Column, Attia Hosain presents a more or less complete picture of Partition and fills up a lot many gaps in traditional historiography and though indirectly, questions almost all of its basic assumptions. Ice-Candy Man chiefly focuses on the basic animal instincts in men which are brought out effectively by the character of the Ice-Candy Man itself. He doesn’t come across as a positive character yet, Lenny likes him! Even after he abducts ayah and ill treats her, Lenny sympathizes with him. She says she can see him as Godmother sees him treacherous, dangerous†¦. but, yet she considers him harmless! With the novel written in first person and the fact we see everything from Lenny’s perspective, this is significant. That is, we identify with Lenny who in turn identifies with ice-candy man (a royal bastard! ) whom we hate!!! A wonderful irony on human nature!! And, this perhaps can be seen as one possible reason for partition. Also, the novel is terribly biased against politicians. Sidhwa lashes out on politicians especially Indians though there is an indirect sarcasm at Pakistanis as well. And, Ice-Candy Man is a kind of politician or rather the bridge between the common man and cold, calculating, icy politicians. Its portrayal of the suffering of women and ‘abducted’ women’s recovery camp in its full complexities unlike the other texts, is quite meritious. Ayah is abducted and converted into a prostitute; the women in Ranoo’s village are tortured like hell so, much that they prefer death to it. Hamida, is recovered but, her family refuses to accept her. Lenny just can’t bring herself to terms with it: â€Å"Hamida was kidnapped by the Sikhs†, says Godmother seriously. On serious matters I can always trust her to level with me. â€Å"She was taken away to Amritsar. Once that happens, sometimes, the husband-or his family-won’t take her back. † â€Å"Why? It isn’t her fault she was kidnapped! † â€Å"Some folk feel that way-they can’t stand their women being touched by other men. † It’s monstrously unfair: but Godmother’s tone is accepting. I think of what Himat-Ali -alias- Hari once told me when I reached to lift a tiny sparrow that had tumbled from its nest on our veranda. â€Å"Let it be,† he’d stopped me. the mother will take care of it. If our hands touch it, the other sparrows will peck it to death. † â€Å"Even the mother? † I asked. â€Å"Even the mother! † he’d said. It doesn’t make sense – but if that’s how it is. It is. But, though it stresses on women’s suffering, it doesn’t quite question the patriarchal not ions of power and treatment of women as passive victims. No where does it question the use of women's identities and bodies as symbols of community honor and ‘tradition' that makes them targets of violence during sectarian conflicts. It elaborates equally well on the women’s recovery operation and even accepts that it can’t wipe out the past or truly ‘recover’ them, but doesn’t quite question the purpose of it all. This is probably, because the only female character that emerges very strong is Godmother’s but, the power and authority that she exercises is very patriarchal in nature. Lenny’s mother is portrayed as a very feminine character but, she cannot save Ayah from Ice-Candy Man. Though towards the end she says, Give me the (mystic) wine that burns all veils, The wine by which life’s secret is revealed. The wine whose essence is eternity. The wine which opens mysteries concealed. Lift up the curtain, give me power to talk. And make the sparrow struggle with the hawk. – Iqbal The sparrow or the women has to struggle with the hawk or the men in order to survive!! Apart from these, she highlights how religion had transformed (or probably still is) from being a faith or a belief to a weapon. â€Å"One man’s religion is another man’s poison. † Also, unlike the other two texts, this isn’t staged in one country only, though indirectly (through Ranoo) but, it does go to India. Also, there is an indirect mention of Bengal as in Gandhi’s fasting stops riots from reaching Bihar (though Sunlight on a Broken Column too deals with partition at the Bengal border and that too more directly). Besides, at a domestic level, it shows breaking up of families due to death of some members in riots, as in Ranoo’s family. Socially and culturally it well portrays division of people into Hindu, Muslim, Sikh and hence, the colours in the park are gone. As for biases, it is clearly a Pro Parsee, Pro Pakistani novel. Parsees emerge miraculously unaffected by everything on the contrary they are the ones who at times set things right. Lenny’s mother and aunt help their neighbors get petrol, Godmother manages to get Ayah released from the captive of Ice-Candy Man within a fortnight, which had it not been for her would have been consigned to the ingenious bureaucratic eternity of a toddler nation greenly fluttering its flag – with a white strip to represent its minorities. And, though Sidhwa makes a desperate attempt to sit over the fence it collapses in the dinner table scene n epigraph when she blames the British. And, it is very much governed by Political Biases. It is clearly pro Jinnah, and lashes out on Gandhi without quite justifying. On the whole, it brings out the power dynamics and links it well to the basic human tendencies. 1947 Earth focuses on the loss of innocence through the transformation of Dilnavaaz from a common man to a sadistic, cold blooded criminal. It too highlights the basic animal instincts in men. Dilnavaaz says, â€Å"Santabibi, yeh sirf Hindu aur Musalman ki baat nahi hai. Yeh to kuch hum sab he andar hai. Hindu, Musalman, Sikh hum sab haramzadey hain. Sab janwar. Chidyaghar ke us sher ki tarah jissey Lenny baby itna darti hain. Kaisey pada rehta hai is intazar main†¦. ke pinjra khuley aur jab pinjra khulta hai to Aalah he malik hai. † And, then he asks Shantabibi to marry him saying, â€Å"tumhara sath hoga to yeh janwar hai jo yahan merey andar woh kaboo mein rahega. † And when she doesn’t marry him, he abducts her which, brings out the fact women are made victims of men’s hatred and jealousy. Also, it is brings out the psychological implications of the partition very well. The sense of insecurity and fear runs through out the movie. For example, the car scene, the surrounding by the mob at the end etc. Besides, it shows Hindus, Muslims, Sikhs, Parsees all equally affected. And, even questions though indirectly as to what religion is when, Lenny’s father comments on the marriage and conversion of Papoo to Christian saying, â€Å"good move, anyways, Hindu Gods don’t count much for the happenings in Lahore this days. † Most importantly, unlike the other two texts, it links it very well with the present and brings out the relevance wonderfully. At the end, what happened to Ayah isn’t clearly stated, Deepa Mehta leave a question mark there but, says, mainey apni Ayah ko us din ke baad kabhi nahi dekha , 1947 ke us din ke bad jab mainey apni Ayah ke sath apney vajud, apney dil ka ek hissa hamesha ke liye kho diya tha† Dissmissing the question on her fate as whatever it was, was obviously tragic and hopeless and instead linking it to our identity and finally, questioning the audience w ith the song, â€Å"Ishwar, Allah†¦. † Because, more than 50 years have passed since partition, and yet the riots haven’t really stopped! Partition was more than anything birth of Hindu-Muslim hatred which will probably never die. As for demerits, it’s a pro India, pro Hindu novel. It’s silent politically, but, openly blames the British without really examining the causes. It is also silent on the women’s recovery operation. Besides, it doesn’t talk of the partition on the Bengal border. But, on the whole, Deepa Mehta has packed a lot in the 3-hour movie and brought the relevance of the partition literature well. Looking at all three texts, simultaneously, I personally, feel Sunlight on a Broken Column questions the traditional historiography at almost all levels unlike Ice-Candy Man and 1947 Earth. So, going by the criteria of questioning traditional historiography, it portrays the Partition of India best. Though even 1947 Earth and Ice-Candy Man do it but, to a lesser extent. 1947 Earth highlights the massacre and suffering and stresses more on the psychological impact and relevance as of date but, it doesn’t question that many or even that far the assumptions of traditional historiography. Ice-Candy Man on the other hand focuses on the ill-treatment of women very well, but, it doesn’t quite question the patriarchal power system and its assumptions.

Emotional Couples Therapy Essay

This is a paper on a video named Emotional Focused Couples Therapy, it is about a couple that is talking to a counseling professional about issues they are having, the biggest one being the husbands anger. Throughout the videos you see how the professional uses the three stages in interviewing to support the couple. She also does a great job on summarizing and paraphrasing what the couple is saying and feeling. The professional uses both open and closed ended questions during the session. There is also a lot of body language happening by everyone involved, some good and some bad. The professional really shows the clients that she is really there for them in her body language and the way she is reflecting their feelings back at them. The couple listens to each other and expands on their feelings with the support of the professional. They also both realize that they want to work things out between them and are willing to keep working at their relationship. Open and Closed Ended Questions In this therapy session the therapist asked many open and closed ended questions to help get the full picture of the client’s relationship. When the therapist was asking these questions she was using verbal and nonverbal cues from the couple, to see how and what she should be asking next. The questions that where asked in this session is: 1. Is it hard to be supportive? 2. Is it had to be close? (Meaning affectionate) 3. Do you withdraw? (From the conversation and the relationship) 4. How do you deal with the message, that you are a are screwed up? (Not ever said he just fees that way.) 5. Are times that you can be close? (Affectionate) 6. Do you think that your wife sees you as a mean and nasty person? 7. Do you feel rejected? 8. Am I getting it? (The therapist states this several times during the session as she is reflecting on their conversation.) 9. Is lonely an ok word to use? (The wife was having a hard time thinking of a word.) 10. Scott do you think that you wife knows how you feel? 11. Do you feel that she does not care in the heat of the moment? 12. Have you ever tried to explain to her how you are feeling? 13. Can you help her understand the feeling of rejection? 14. What is it like to tell her how it makes you feel when you feel rejected? 15. What would be the worst thing that would happen if you told your wife your softer feelings? 16. Would you like to be able to trust your wife and be able to talk about your softer feelings? 17. Would you like him to be able to talk about his softer feelings? 18. Do you let the feelings touch you at all? 19. Do you hear her and find that comforting? (The feelings) 20. What do you think about what he did today? (Opening up during the session.) This professional has a way that when she is reflecting what the clients are saying and expression she is asking them if she is right and they add to the conversation. Above are some of the separate questions that she was asking during the session. There were very few closed ended questions. She would reflect and they would open up even more. The professional summarized and paraphrased what the couple was saying many times during the session to make sure that she understood what they were saying is what she was hearing. The professional was very effective in summarizing and paraphrasing the relationship and the feelings that both parties were talking about and expressing. Verbal and Nonverbal There was verbal and nonverbal communication, actions and skills happening in the session by the couple and the professional. Watching the couple expressional the husband he had his arm and feet crossed and turned away from his wife most of the session. The wife kept going from arms being crossed to out in front of her. She also was turned away from her husband  most of the session. The couple showed in their nonverbal body language that there was a problem and they both where uncomfortable with the situation. When certain question and answers where given the body language changed in the couple. The professional could tell when something was uncomfortable by their body language and she help the couple talk about it more, even though they were not picking up on the nonverbal cues for each other. The professional at the beginning had paper in her lab taking notes, after a while she put it down and leaned forward towards the couple showing them that she was really listening to them and was really involved in what they were saying to her. The professional was able to use verbal and nonverbal skills to help the couple during this session and help them to start to listen to each other. The verbal skills that the professional used where very effectively, she was to be able to summarize their feelings and thought. The nonverbal skills showed the couple that she was supportive and involved in helping them. By sitting up and leaning forward in her chair it was another way for the couple to see she was involved in the conversations. Stages of the Interview There are three stages to an interview, exploration, clarification and action. The exploration stage involves helping the client examine his or her thoughts and feelings. The second stage is exploration helps the clients understand their feeling and their thoughts. The final stage is action, which is where the clients start making the change towards their goals. During this interview, the professional listen to both clients on what they thought was the problem and their feelings. They both agreed that anger was the steam of the troubles that they were having, and them not listening and communicating with each other. When the second stage was introduced the professional was involved more. She helped both parties of the couple to understand and reflect on what they each where saying and helping them truly understand and really listen to each other. The professional also very effectively summarized and paraphrased what they were saying again, so maybe they could hear it said in a different way. By doing this she was able to get even more information from them about more if the true problems they were facing. The third and final stage is action. During this session you see that they are starting to listen to each other  and even open up more. Having the husband talk about his softer feelings and also for him to hear that is wife does not think that he is a monster was a great start to the process. They both also stated that they want to work things out and be together. That statement alone should the professional that they both were committed to the process. Self-disclosure and Reflective Feelings During the interview the professional really worked hard to get the couple to talk about their feelings and express their thoughts. Throughout she was able to get them both to self-disclose and reflect on each other’s feelings. As times this was not an easy thing to so especially for the husband but he did do it. He was not sure about showing his softer side, he thought it made him feel week and like a sissy. The wife disagreed she thought the angry side of him was the sissy side. They both listened to each other’s feeling and acknowledge them and respected them throughout the session, but may not have always agreed with them. This interview was very emotionally charged and at sometimes uncomfortable for the couple. With that said, they both listened and rejected each other. The professional was able to summarize both of their feelings very well, and understand what both of them where saying about the situation. Overall the therapy session was a great starting point by the couple not no were being done with their therapy and situation. Being able to talk about feelings is hard and sometime intimidating, when you are in front of a stranger. The comfort level of the session was ok, they looked uncomfortable, not just because they were there but the chairs and the overall appearance of the room, not very inviting. The structure of the interview flowed very well and the professional was able to keep the conversations moving in the right direction so the session was helpful for the couple. References (2009). Free trade leads to social damages since no restrictions will mean reduced wages following de-unionizing of workers and eliminating their rights. Supporters of this will claim that it will lead to increased growth. They fail to realize that it will not benefit everyone bit will oppress the majority. Expenses for infrastructure and social amenities such as hospitals and schools as well maintenance costs of infrastructure of road is minimised in the name of reducing government role. This is done but benefits received by the government such as subsidies and taxes are not minimised. Privatization of state owned enterprises and services such as banks, key industries, social amenities and electricity as well as fresh water supply. This will of course lead to concentrating the wealth only for the minority and the major populace

The bronze casements, such as, windows and doors, were not unique in the market. Therefore, the parent company in France decided to start a new affiliated company in the U.S. to sell the new line of products, bronze windows, and door casements. Although both companies shared the same name and had the same line of products but they were different in organization and management. During my interview for the job in that company, I trie d to stress on the benefits that the company could get by hiring me instead of talking about the great opportunity of doing job in that company. I also did not talk anything about how the job could allow me to do the things that I had never done before. He tried to visualize God but failed to understand how something could exist without occupying space. He also did not find a solution to his question about evil. For a while, he suspected that evil could be the result of human will, but again wondered if God was all-powerful, how humans could choose evil over Him. It was when he read certain books of the Platonists that were translated from Greek to Latin, that he was inspired to have a powerful vision of God.

Ethical Issues In Contractors Tendering Practices Construction Essay Ethics examine the morality of human conduct; it studies the basic principles of moral behaviour and is concern with the right or wrong of human behaviour. Every rational human being has an idea of what it is for something to be right or wrong, although sometimes it is difficult to evaluate what is wrong or right depending on the circumstance of such action (Etim, 1999). Business ethics is therefore a collection of moral principles or a set of values dealing with what is right or wrong, good or bad in business transactions. Such sets of values are being shared within the business community as well as the society as a whole. Moral ideas are considered to be inappropriate for everyday business dealings and some actions are disregarded due to the strong desire to make profit. Some have argued that ethics and business do not mix, and that the two are in direct conflict with each other. In fact, it has been said that companies that are truly ethical are going out of existence. Construction contracts can be obtained by negotiation or by competitive tendering (Shash, 1993; Ashworth, 2001). In competitive tendering, an owner invites a selected number of contractors to compete for the project. This method of tendering is considered as the most common means by which building and engineering contracting firms obtain works, and the dominant mechanism for allocating construction contracts (Ward, 1979; Yusif and Odeyinka, 2000; Ashworth, 2001; Hiyassat, 2001; Harris and McCaffer, 2001; Shen et al, 2004). The business of tendering for construction contracts has a large ethical component. Ethical principles in tendering are formally prescribed in the codes of conduct related to tendering process. The codes are designed to delegate responsibilities to both competing contractors and the client and to minimize the potentials for unethical practices. This work intends to examine cover pricing, collusive tendering and rate loading among other unethical practices which construction contractors sometimes engage in during tendering. Cover pricing in construction tendering Fu, Drew and Lo (2004) observe that contractors tendering behaviour is subject to their winning intent. It is however known that winning may not be the only objective in tendering. Although the tendering codes stipulates that tenderers shall only bid where they intend to carry out the work if successful, some contractors for some reasons sometime decide to submit tenders based on cover-price. Cover prices are tender prices which have been provided at rates specifically designed to lose the tender but which may appear to be competitive. Despite attempts to prevent this practice, several instances of cover pricing sometimes called non-serious tenders have been reported. When a contractor with a reasonable workload receives a set of tender documents from a reputable client and consulting organizations, the contractor has to decide what to do: first whether to do nothing, to return the tender documents or to submit a tender. A tender may be submitted in one of three ways: by obtaining a cover price, by preparing a tender based on accurate estimate, and by preparing a tender based on approximate estimate. The option to do nothing is not considered suitable due to the potential harm such a course of action might cause to the reputation of the contractor with the client, consultants and their business contacts. Also the option of returning the tender documents may be perceived by the contractor as unsatisfactory because it might mean exclusion from future tender list, although this should not be the case according to the code of procedure for tendering. Some reasons for the issuing of cover price by contractors to include: little interest in the contract; lack of resources to competently complete the work; shortage of time to compile tender; desire to remain considered for future contracts; and little chance of winning due to the large number competing contractors for the same contract. It is reported in Skitmore and Runeson (1999) that clients often give the perception that a failure to tender will prejudice a contracting firm in the future tendering exercise, and the consequence of this is the so called cover price which cannot easily be distinguished from a genuine competitive tender. Also, Runeson (1988) remarks that some tenders are based on cover prices not intended to win the contract and therefore above the expected price, and submitted to recover deposit moneys or to keep faith with the client or consultants. However, Lowe and Parvar (2004) provide a different perspective to cover pricing. They submit that tendering options available to a contractor are simply acceptance or rejection of the tendering opportunity, although, rejection does not mean that the contractor does not submit a tender. Unsatisfactory past experience with a particular client or consultants regarding personality or payment, high cost of tendering and inadequate information often resulted in inflation of the tender price (cover price) rather than a refusal to tender. Cover price can ruin the competitiveness of a tendering process and can also lead to collusion among tendering contractors. However, despite its unethical nature and illegality in some countries, there are some arguments in its favour. The shortage of time to compile a bona fide tender could compel a contractor to submit tenders based on cover price. The recognition of this fact may have prompted the Nigerian Institute of Quantity Surveyors (NIQS) in its Code of Procedure for Competitive Tender to state that: time allowed for completion of tender should relate to the scope of project. Adequate tendering time allows tenderers to obtain competitive quotations and thus, ensure the return of most competitive prices with least mistakes (Clause 4.2.1) Lowe and Parvar (2004) believe that only few contractors will actually decline an invitation to tender. However, it appears that contractors react differently to the perceived fear that the option of returning tender documents might exclude them from clientsà ¢Ã¢â€š ¬Ã¢â€ž ¢ future tender process The report of a survey of some Nigerian building contractors indicate that when they receive a set of tender documents at a time their firms have a reasonable workload, they return the tender documents to the clients or their representatives with an apology for their firmsà ¢Ã¢â€š ¬Ã¢â€ž ¢ inability to tender. Only a few contractors admit to engaging in the practice of cover pricing. Contractors who admit to using cover pricing in tendering reveal that their action is mostly driven by little or no interest in the contract under consideration and the desire to remain considered for future contracts and tendering process. Some contractors cited other reasons such as the personality of the cl ient, risk and unpredictability of the construction period as well as heavy workload as some reasons why cover pricing may be an option for their firms. Whether or not a cover price is provided with good intention, the fact remains that it results in lessening real competition of tenders. Collusion in Tendering Chen et al (2005) submit that one purpose of the standard tendering procedures is to reduce potential for collusion and manipulation of pricing. According to Ray et al (1999), collusion is a method of pricing control by contractors to substantially lessen competition. Collusive tendering occurs where several contractors have been invited to tender and the contractors agree among themselves either not to tender, or to tender in such a manner as not to be competitive with the other contractors. It has the effect of substantially lessening competition. The main reasons for this practice among contractors are that it provides: an even distribution of construction work for all the contractors involved a means of entering what is an apparently bona fide tender a means for discussion and agreement over illicit profit making such as amounts for cover price, and unsuccessful tendering fee. The practice, or possibilities for the practice of collusion is a factor among several other issues related to ethical tendering, and it is contrary to the ideals of competition. It only benefits those parties to the agreement at the expense of those outside, including clients and other contractors. Sheldon cited in Ray et al (1999), while examining collusion in the UK, holds that collusion agreement are seen as an attractive means of maintaining a steady flow of work and achieving higher, risk-adjusted, discounted profit. The tender codes of some countries clearly prohibit unethical practices such as collusion on tenders, inflation of prices to compensate unsuccessful tenderers or any such secret arrangements. The very fact that tendering contractors communicate with each other can be taken to be a form of collusive behaviour under competitive tendering process. Though, little evidence of collusive tendering seems to be available in Nigeria construction industry, it is pertinent for industry practitioners and clients to be aware of the possibility of such unethical practice. Rate loading Usually, a construction tender is priced in such a way that the prices of each item comprise the cost of that item plus a uniform percentage allowed as profit and overheads. This is not always the case. Contractors may mark up the bill items by different percentages to create some element of rate-loading in order to create a favourable cash flow. Two aspects of rate loading are front-end loading and claims loading. Construction contracts only become self-financing towards the completion of the project. Therefore contractors are required to engage a considerable amount of their own capital in the execution of the work, at least in the early stage. In an attempt to minimize the involvement of their capital and make the project self-financing at an early stage, they resort to price manipulations. Items which the contractor expects to be executed early in the project have prices which contain a disproportionately large content of overheads and profits and items to be executed in the later stage of the project have their prices reduced accordingly to maintain competitiveness (Fellows et al, 2002). This pricing strategy in construction tenders is referred to as front-end loading. Due to the time-value of money, the situation further benefit contractors but place a cash flow burden and greater risk on clients. There is also the practice of claims loading where contractors insert higher profit margin into unit rates related to those work items which they expect to be increased through variation orders during the execution of the contract (Xu and Tiong, 2002). Conclusion Unethical tendering practices such as cover pricing, collusive tendering and rate loading have the potential of reducing real competition and eroding the benefits of competitive tendering. They can also place enormous financial burden on client. Construction consultants therefore have a duty to carefully examine tenders for construction contracts to identify any such practice and possibly caution or sanction contractors who may have engage in these practices.

The Cider House Rules, begins in the 1920s in St. Cloud's orphanage in Maine where Homer Wells is born and spends most of his teenage years. Three times he is adopted by good families, but later returned to the orphanage. Dr. Larch, who is in charge there, would just as well have him stay, for he later becomes a good assistant to the doctor in performing abortions and delivering babies. Wally Worthington, whose wealthy parents are in the apple and cider business gets to know Homer when Wally, takes his girlfriend Candy to the St. Cloud's orphanage for an abortion. These three become close friends and Homer accompanies them back to their hometown where he spends the next six months. It's a new life for Homer, and he realizes that his years at the orphanage are just the past and it is time for him to move on. 1. Which of the different product mix pricing strategies applies best to Payless’s new strategy? To my view they are using mix of different strategies. Firstly, skimming pricing. This is about selling a product at a high price, sacrificing high sales to gain a high profit, therefore ‘skimming’ the market.
